Terms of Service
These Terms of Service (“Terms”) govern your use of the Burger Tower mobile game and related browser version (the “App”), provided by Barako Technologies Inc. (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App for your own non-commercial entertainment on devices you own or control. We retain all rights, title, and interest in and to the App, including its code, art, sounds, and trademarks.
2. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law.
- Modify, cheat, exploit, or use automated tools to interfere with normal gameplay or scoring.
- Distribute, resell, sublicense, or commercially exploit the App without our permission.
- Use the App in any unlawful manner or to infringe the rights of others.
3. Virtual items — no real-money value
Scores, ranks, combos, coins, unlocked ingredients, the calorie tally, and any in-game items or progress are for entertainment only. They have no monetary value, cannot be exchanged for cash or anything of value, and are not your property. We may modify, reset, or remove them at any time. The App does not currently offer real-money purchases; if that changes, additional terms will apply and we will update these Terms first.
4. Advertising
The App displays third-party advertising through Google AdMob. We are not responsible for the content of ads or for any products or services they promote, and your interactions with advertisers are solely between you and the advertiser. See our Privacy Policy for how advertising data is handled.
5. Disclaimers and warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure. The in-game calorie figures are fictional and are not nutritional advice.
6. Limitation of liability
To the maximum extent permitted by law, Barako Technologies Inc. and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the App. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the App (which, for this free App, is zero) or US$100.
7. Governing law
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in Metro Manila, Philippines for any dispute not subject to mandatory consumer protections in your place of residence.
8. Changes to these Terms
We may update these Terms from time to time. We will revise the “Effective date” above and, for material changes, provide additional notice as required by law. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
9. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms or for any lawful reason. Upon termination, the license granted in Section 1 ends and you must stop using the App.
